These Terms of Service govern your use of MPact, a marketing service offered by Momentus Advisory LLC ("Company," "we," "us," or "our"). By signing up for or using the MPact service, you agree to these terms.
MPact is a done-for-you marketing service designed for home builders and contractors. The service includes ongoing social media content creation, scheduled posting support, and Google Business Profile support, as described on our website.
MPact is a defined, repeatable service. It is not a custom agency engagement, and the scope of deliverables is fixed as described at the time of purchase.
You must be at least 18 years old and have the legal authority to enter into a binding agreement on behalf of yourself or your business to use this service.
MPact is offered on a monthly or annual subscription basis.
All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees on a recurring basis until you cancel.
Prices are subject to change with 30 days' written notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
Monthly subscribers may cancel at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.
Annual subscribers may cancel at any time, but are not entitled to a pro-rata refund for the unused portion of their annual term unless required by applicable law.
All sales are final except where required by law. If you believe there has been a billing error, contact us within 30 days of the charge at the address below.
Content created by MPact on your behalf (social media posts, Google Business Profile updates, etc.) is created for your business use. Upon full payment, you retain ownership of content published to your accounts.
You grant Momentus Advisory LLC a limited license to access your social media accounts and Google Business Profile solely for the purpose of delivering the service.
You agree not to use MPact for any unlawful purpose, to misrepresent your business, or to request content that is misleading, defamatory, or violates the terms of any third-party platform (including Google, Facebook, or Instagram).
To the fullest extent permitted by law, Momentus Advisory LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the MPact service, including but not limited to loss of revenue, loss of data, or business interruption.
Our total liability for any claim arising under these terms shall not exceed the total fees paid by you in the three months preceding the claim.
The MPact service is provided "as is" and "as available." We make no guarantee that the service will increase your revenue, leads, or visibility, or that results will meet your specific expectations.
We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, with or without notice. Upon termination, your access to the service will cease immediately.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Kalamazoo County, Michigan.
We may update these Terms from time to time. We will notify you of material changes via email or a notice on our website. Continued use of the service after changes are posted constitutes acceptance.
